fine on Goel Ganga Developers for violating environmental laws by carrying out construction over and above the clearance obtained from the Environment Department It also imposed a fine of Rs 5 lakh on Pune Municipal Corporation for “deliberate or otherwise suppression of facts” in the case and misleading the Environment Department The zonal bench headed by justice Dr Jawad Rahim and comprising expert member Ajay A Deshpande also directed Chief Secretary Government of Maharashtra to conduct a probe in the manner in which the government officers behaved Watch What Else is Making News The case related to a project by the group in village Vadgaon Budruk on Sinhagad Road for which a permission of construction of 12 buildings having 552 flats 50 shops and 34 offices was taken in 2008 However it was later pointed out that instead of amending the environmental clearance (EC) the builder carried out construction of 15 buildings and raised the number of flats to 738 and that of shops to 111 An inspection carried out by Member Secretary of Maharashtra Pollution Control Board (MPCB) in August 2015 found out non-compliance of the terms on which the EC was granted to the developer The tribunal held up this view taken by the MPCB calling it a ‘gross violation of the terms and condition on which the EC was granted by Ministry of Environment and Forestry” The tribunal then went ahead with imposing a hefty fine on the group which it said would serve as a deterrent “Environmental compensation cost of Rs 100 crore or 5 per cent of the total cost of project to be assessed by SEAC (State Expert Appraisal Committee) whichever is less for restoration and restitution of environment damages and degradation caused by the project by carrying out the construction activities without the necessary prior approval… In addition to this it shall also pay a sum of Rs 5 crore for contravening mandatory provision of several environment laws in carrying out the construction activities in addition to and exceeding limit of the available environment clearance and for not obtaining the consent from the Board” said the bench It also passed strong strictures against PMC officers for what it called “deliberate or otherwise suppression of facts” “In view of our finding that there has been manifest deliberate or otherwise suppression of facts of illegality in the project activity of Goel Ganga Developers by the officer of PMC we impose a fine of Rs 5 lakh upon the PMC and direct PMC Commissioner to take appropriate action against the erring officers The amount of Rs 5 Lakh shall be paid within one month” reads the judgment “The Tribunal is expected to operate on the principles of Sustainable Development and ‘Polluter Pays’ principle We are conscious of the fact that ‘Polluter Pays’ principle shall not be construed as ‘pay and pollute principle’ and the payment has therefore to be exemplary and deterrent in order to pass a clear message that environmental compliance is
